Introduction

Phone Hungers (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), it is our policy to reply to notifications of purported copyright infringement.

Notification of Copyright Infringement

If you think that your copyrighted work has been copied in a way that violates copyright and is available on the Phone Hungers website (https://phonehungers.com/), you can let us know by sending the following written information to our authorized copyright agent:

  1. Identification of the Copyrighted Work: Identify the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, provide a representative list of such works.
  2. Identification of the Infringing Material: Determine which content needs to be deleted or accessed restricted because it is allegedly infringing or the target of infringing activities. Add details that are at least somewhat sufficient to help us find the content.
  3. Contact Information: Provide information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
  4. Good Faith Belief: Include a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy of Information: Add a declaration certifying, under penalty of perjury, that the information in the notification is true and that you are authorized to act on behalf of the owner of the allegedly infringed exclusive right.
  6. Signature: Provide a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Action Upon Receipt of a Proper Notice

Upon receipt of a proper notice of claimed infringement, Phone Hungers will respond expeditiously to remove, or disable access to, the material that is claimed to be infringing or to be the subject of infringing activity. Phone Hungers will also comply with the appropriate provisions of the DMCA in the event a counter notification is received.

Counter Notification

If you believe that your material that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the content in your material, you may send a counter notification to our Copyright Agent containing the following information:

  1. The materials that have been deleted or to which access has been restricted, as well as the place where the materials were previously available, should be identified.
  2. A declaration made under penalty of perjury stating that you sincerely believe the material was removed or disabled due to an error or misidentification of the content that was to be removed or disabled.
  3. Provide your name, address, phone number, and email address; additionally, indicate that you agree to the federal court’s jurisdiction over you; and last, indicate that you agree to accept process from the individual who notified you of the alleged infringement.
  4. Your physical or electronic signature.

Please be aware that anybody who intentionally makes a materially false representation that any content or activity is infringing may be held liable under Section 512(f) of the DMCA.
